OVERVIEW

Welcome to marçel. The terms "we", "us" and "our" refer to marcel s.r.o., the company operating the marçel brand.

This website, including all information, content, features, tools, products and services (the "Services"), is operated by marcel s.r.o. to provide customers with a tailored shopping experience. The Services are technically powered by Shopify.

1. ACCESS AND ACCOUNT

By using the Services, you confirm that you are at least 18 years old or are using the Services with the consent of a legal guardian.

You agree to provide true, current and complete information. You are fully responsible for the security of your account.

2. PRODUCTS

The appearance of products may vary slightly depending on your device.
We reserve the right to change products, prices or their availability.

3. ORDERS

By submitting an order, you make an offer to conclude a purchase contract.

The contract is concluded only upon confirmation of the order by the seller.

We reserve the right to refuse an order.

4. PRICES AND PAYMENTS

Prices include VAT (unless stated otherwise).
The delivery cost is stated in the order.

The customer is obliged to pay the total price including delivery.

5. DELIVERY

Delivery times are indicative.

Under EU law, the risk of damage to the goods passes to the customer only upon receipt.

We are not liable for delays caused by the carrier or force majeure.

6. RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with Directive 2011/83/EU and Slovak Act No. 108/2024 Coll. on Consumer Protection. Consumers habitually resident in another country retain the rights granted to them by the mandatory provisions of that country.

Exceptions:

The right of withdrawal does not apply to:

goods made to the customer's specifications or made to measure
personalised products
sealed goods not suitable for return for hygiene reasons, if unsealed after delivery

You may try the goods on to the extent necessary to establish their nature, characteristics and functioning, as you would in a physical store. You are liable for any diminished value of the goods resulting from handling beyond this. 7. CLAIMS AND WARRANTY

Liability for defects is governed by Act No. 40/1964 Coll. (Civil Code), as amended, and Act No. 108/2024 Coll. on Consumer Protection.

The seller is liable for defects existing upon receipt of the goods and for defects appearing within two years of receipt. To make a claim, contact info@marcelpourmoi.com; claims are resolved without undue delay, at the latest within 30 days of submission.

8. INTELLECTUAL PROPERTY

All content belongs to marcel s.r.o. or its partners.
Its use without consent is prohibited.

9. THIRD-PARTY SERVICES

We are not liable for third-party services.

10. PERSONAL DATA PROTECTION

Data processing is governed by the GDPR:

11. LIMITATION OF LIABILITY

Liability is limited to the extent permitted by EU law.

12. GOVERNING LAW

These terms are governed by the law of the Slovak Republic.

14. ALTERNATIVE DISPUTE RESOLUTION

If the seller rejects a consumer's request for redress or fails to respond to it within 30 days of its dispatch, the consumer has the right to submit a proposal for the initiation of alternative dispute resolution to an ADR entity in accordance with Slovak Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes, as amended.

Consumers may also contact any other authorised legal entity listed in the register of ADR entities kept by the Ministry of Economy of the Slovak Republic:

Consumers have the right to choose which ADR entity to approach.

Alternative dispute resolution applies exclusively to disputes between a consumer and a seller arising from or related to a consumer contract.

It is available only to consumers — natural persons not acting within the scope of their business activity.

The ADR entity may reject a proposal if the value of the dispute does not exceed EUR 20.
